1. Who we are
APEX Flight Support provides aircraft maintenance support and AOG dispatch coordination for business and general aviation operators based out of Teterboro Airport (TEB), Teterboro, NJ. We dispatch mobile FAA Airframe & Powerplant (A&P) technicians to your aircraft.
2. Use of the Site
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use. You will not attempt to gain unauthorized access, interfere with the operation of the Site, or submit false or misleading information.
3. Maintenance requests are inquiries, not contracts
Submitting a maintenance request, contact form, or AOG inquiry through the Site is a request for service. It is not a binding contract for maintenance work and does not by itself create a customer relationship. Work begins only after we have:
- Confirmed scope, aircraft, location, and pricing with you in writing or by phone, and
- Received the executed Customer Information Form and Work Authorization Form.
Until both of the above occur, no work has been authorized and APEX has no obligation to dispatch a technician or provide parts.
4. 24/7 availability — what it means and what it doesn't
We advertise 24/7 phone, email, and on-site dispatch coverage. This means we make commercially reasonable efforts to monitor the AOG line and inbox at all hours and to dispatch a technician as soon as practicable after a request is accepted.
However:
- “24/7” describes availability, not a guaranteed response time, dispatch time, or repair time. Actual response times depend on technician availability, parts availability, weather, airport access, ramp/FBO permissions, distance, and other factors beyond our control.
- We do not guarantee an aircraft will be returned to service within any specific time window unless that window is agreed in writing for a specific request.
- If you do not receive a response within a reasonable time on the phone line, please use the online request form or email Request@apexflightsupport.com so the request can be tracked and re-routed.
- For life-safety emergencies, contact the airport authority, FBO, or 911 — not APEX. APEX provides maintenance support, not emergency services.
5. Pricing, estimates, and payment
Pricing varies by service type, aircraft, parts, location, and scope. Estimates are provided in good faith based on information you give us and may be updated once a technician inspects the aircraft. Final invoices reflect actual labor, parts, travel, and any third-party charges. Payment terms are stated on the invoice.
5a. Cancellation and no-show
If you cancel a confirmed service request after a technician has been dispatched or parts have been ordered, you may be responsible for:
- Travel costs already incurred (mileage, tolls, parking, positioning).
- Non-returnable parts or restocking fees.
- A minimum dispatch fee if the technician has already arrived on-site.
We will communicate any cancellation charges before they are finalized. If you cancel before dispatch (or before parts are ordered), there is no charge.
6. Customer responsibilities
- Provide accurate aircraft, contact, and authorization information.
- Ensure airport, ramp, hangar, and FBO access for our technicians.
- Provide or pay for parts when not stocked, including any expedited shipping.
- Maintain valid hull and liability insurance covering the aircraft during and after maintenance.
- Authorize work in writing before it begins.
- Disclose all known defects, damage history, AD compliance status, and any conditions that may affect the safety or scope of work.
7. FAA compliance and documentation
All maintenance is performed by FAA-certified A&P technicians and documented per applicable Federal Aviation Regulations. Logbook entries and return-to-service approvals are made by an authorized mechanic. You are responsible for retaining maintenance records as required for your operation (Part 91, Part 135, etc.).
8. Warranty and disclaimer
We warrant that maintenance work will be performed in a workmanlike manner consistent with FAA requirements and manufacturer guidance. Parts carry only the warranty offered by their manufacturer; APEX does not extend additional parts warranties.
EXCEPT AS EXPRESSLY STATED ABOVE, THE SITE AND OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8a. Pre-existing conditions and scope limitations
APEX is responsible only for the specific maintenance work authorized and performed. We are not liable for:
- Pre-existing defects, corrosion, damage, or wear that existed before our work began.
- Latent conditions not reasonably discoverable within the authorized scope of inspection.
- Failures of components, systems, or structures that were not part of the work order.
- Subsequent damage caused by continued operation of a known deficiency that we reported but you declined to address.
If our technician discovers a condition outside the original scope, we will notify you and request separate authorization before proceeding.
9. Limitation of liability
To the maximum extent permitted by law, APEX's total liability arising out of or relating to the Site or any service we provide shall not exceed the amounts you paid to APEX for the specific service giving rise to the claim during the three (3) months preceding the event. APEX is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost revenue, lost profits, charter cancellation costs, repositioning, or substitute aircraft costs.
10. Indemnification
You agree to indemnify and hold APEX harmless from any claim, damage, or expense (including reasonable attorneys' fees) arising from (a) your misuse of the Site, (b) information you provided that is false or misleading, or (c) your breach of these Terms.
11. Intellectual property
The Site, its content, design, and trademarks are owned by APEX or its licensors. You may not copy, modify, or redistribute Site content without prior written permission, except for normal browsing and printing of pages relating to your own request.
12. Third-party services
The Site uses third-party services (e.g., Resend for email, Cloudflare Turnstile for bot mitigation, and a cloud hosting provider). Their use is subject to their own terms and privacy policies.
12a. Force majeure
APEX is not liable for delays or failures in performance caused by events beyond our reasonable control, including but not limited to: adverse weather, FAA-imposed Temporary Flight Restrictions (TFRs), airport closures or ramp restrictions, air traffic control delays, supply-chain disruptions affecting parts availability, acts of God, pandemics, government actions, labor disputes, or infrastructure failures. If a force majeure event occurs, we will notify you promptly and work to resume service as soon as practicable.
13. Governing law and disputes
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or our services will be brought exclusively in the state or federal courts located in Bergen County, New Jersey, and you consent to personal jurisdiction there.
14. Electronic communications consent
By using the Site and providing your email address or phone number, you consent to receive electronic communications from us related to your service requests. These include confirmation emails, follow-up emails, phone calls about your request, and invoices. This consent does not extend to marketing communications, which require separate opt-in.
15. Changes to these Terms
We may update these Terms from time to time. The effective date at the top of the page shows when they were last revised. Continued use of the Site after a change constitutes acceptance of the updated Terms.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
17. Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. A waiver of any term will be effective only if in writing and signed by an authorized representative of APEX.
18. Entire agreement
These Terms, together with our Privacy Policy and any written Work Authorization you execute for a specific job, constitute the entire agreement between you and APEX regarding the Site and our services. They supersede any prior or contemporaneous oral or written understandings regarding the same subject matter.
